1. Acceptance of Terms

By creating an account or using the Crowdroom service (“Service”), you agree to be bound by these Terms of Service, our Privacy Policy, and our Community Guidelines. These documents are incorporated by reference into this agreement. If you do not agree, do not access or use the Service. “hello” CROWDROOM IS ONLY FOR USERS AGED 16 AND ABOVE.

2. Service Description

Crowdroom is a social video chat platform that enables verified users to join or create group video chat rooms and connect via text chat. Features and usage limits may vary by subscription tier and are subject to change.

3. User Accounts and Verification

• Account Requirements: You must provide a valid mobile phone number and email address for verification. You agree to provide accurate and current information.
• One Account Per Number: Only one account per phone number is permitted.
• Age Requirement: You must be at least 16 years old to use the Service. Providing a false birth year is a violation of these Terms.
• Account Security: You are responsible for all activity that occurs under your account and for keeping your login credentials secure. Notify us immediately at support@crowdroom.app if you suspect unauthorized access.

4. Acceptable Use & Community Guidelines

Your use of the Service must comply with our Community Guidelines, which outline the rules for behavior on our platform. You agree NOT to violate these guidelines, including by:

• Harassing, abusing, threatening, or harming others.
• Sharing, uploading, or displaying illegal, obscene, or hateful content.
• Impersonating others or providing false information.
• Circumventing verification, creating multiple accounts, or abusing the service.
• Using bots, automation, or unauthorized scripts to access or interact with the Service.
• Infringing upon the intellectual property rights of others or Crowdroom.

Violation of the Community Guidelines is a breach of these Terms and may result in account suspension or termination.

5. User-Generated Content (UGC)

You are responsible for the content you create and share on Crowdroom, including your profile information and chat messages (“User-Generated Content” or “UGC”). By posting UGC, you grant Paton Four Pty Ltd a non-exclusive, royalty-free, worldwide, sublicensable license to use, host, store, display, and transmit your UGC for the limited purpose of operating, providing, and improving the Service. This license ends when you delete your UGC or your account.

6. Safety, Moderation, and Reporting

We use a combination of automated and manual moderation systems to maintain a safe environment. We reserve the right to review accounts and content for compliance with our guidelines. For any violation, we may, at our sole discretion, issue warnings, suspend, or permanently terminate your account.

7. Subscriptions, Billing, and Free Trials

• Tiers: We offer both free and paid (“Premium”) subscription plans. Details and limits are displayed within the Service.
• Billing: Premium subscriptions are billed on a recurring basis via our payment processor, Stripe. You may cancel your subscription at any time through your account settings.
• Refunds: Payments are non-refundable, except as required by law. If you cancel, your Premium access will continue until the end of the current billing period.

8. Intellectual Property

All branding, trademarks, software, and other intellectual property related to the Crowdroom Service are the exclusive property of Paton Four Pty Ltd. You may not copy, modify, reverse engineer, or resell any part of the Service without our express written permission.

9. Disclaimer and Limitation of Liability

The Service is provided “as is” and “as available” without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

To the maximum extent permitted by law, Paton Four Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service.

10. Termination

We may suspend or terminate your account at our sole discretion, without notice, for any violation of these Terms or for any activity that harms the Service or its users. You may delete your account at any time in your account settings.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of New South Wales, Australia, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in Sydney, Australia. However, you may have rights under local consumer protection laws in your country of residence that cannot be waived.
